By accessing or using Wisconsin Raffle (“the Platform,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Platform.

2. Platform Description

Wisconsin Raffle is an online platform that facilitates legal raffle ticket sales for verified Wisconsin 501(c)(3) nonprofit organizations. We provide technology services to enable compliant raffle operations in accordance with Wisconsin state law.

3. Eligibility and Geographic Restrictions

Age Requirements

• You must be at least 18 years old to purchase raffle tickets through our Platform
• By using our Platform, you represent that you are at least 18 years of age

Geographic Limitations

• Raffle ticket sales are limited to residents within the geographic service areas of participating nonprofit organizations
• Sales are restricted to areas where the conducting organization is legally authorized to operate raffles
• You are responsible for ensuring your participation complies with your local laws

4. Account Registration and Security

Account Creation

• You must provide accurate, current, and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account

Account Responsibilities

• You are solely responsible for all activities that occur under your account
• You may not share your account with others or create multiple accounts
• We reserve the right to suspend or terminate accounts that violate these Terms

5. Raffle Participation

Wisconsin Law Compliance

• All raffles conducted through our Platform operate under Wisconsin raffle licenses held by participating 501(c)(3) organizations
• Each raffle complies with Wisconsin Statutes Chapter 563
• License numbers and conducting organization information are displayed for each raffle

Ticket Purchases

• All ticket sales are final — no refunds except as required by Wisconsin law
• You will receive a confirmation email and PDF ticket copy upon successful purchase
• Sequential ticket numbers are assigned automatically and cannot be changed
• Payment must be completed before tickets are considered valid

Drawing Procedures

• Winners are selected through random drawing processes
• Drawing dates, times, and locations are specified for each raffle
• Winner notification will be sent to the email address provided at purchase
• Prize claim procedures and deadlines are specified in raffle details

6. Payment Terms

Accepted Payment Methods

• We accept major credit cards and debit cards through our secure payment processor
• All payments are processed in US dollars
• Payment processing fees may apply

Subscription Services

• Monthly subscription plans automatically renew until cancelled
• Billing occurs on the same date each month as your initial subscription
• You may cancel subscriptions at any time through your account dashboard
• Cancelled subscriptions remain active until the end of the current billing period

Failed Payments

• Failed subscription payments may result in temporary service suspension
• We will attempt to collect payment according to our retry schedule
• Accounts with repeatedly failed payments may be cancelled

7. Prizes and Winnings

Prize Claims

• Winners must claim prizes within the timeframe specified in the raffle rules
• Valid identification may be required for prize claims
• Some prizes may require pickup at specified locations

Tax Responsibilities

• Winners are responsible for all applicable taxes on prizes
• Tax forms will be provided for prizes meeting IRS reporting requirements
• Consult your tax advisor regarding tax implications of winnings

Prize Substitutions

• Organizations reserve the right to substitute prizes of equal or greater value
• Cash prizes are awarded as specified in raffle terms
• 50/50 raffles pay 50% of total ticket sales to the winner

8. Platform Usage Rules

Prohibited Activities

You may not:

• Use our Platform for any illegal purposes
• Attempt to manipulate or interfere with raffle drawings or results
• Create fake accounts or provide false information
• Engage in fraudulent activity or payment disputes without cause
• Reverse engineer, hack, or compromise our Platform security
• Violate any applicable laws or regulations

Content Standards

• User-generated content must be appropriate and lawful
• We reserve the right to remove content that violates our standards
• You retain ownership of content you submit but grant us license to use it for Platform operations

9. Privacy and Data Protection

Information Collection

• We collect information necessary to process raffle transactions and comply with legal requirements
• Our Privacy Policy describes how we collect, use, and protect your information
• You consent to our data practices as described in our Privacy Policy

Data Security

• We implement reasonable security measures to protect your personal information
• However, no internet transmission is 100% secure, and we cannot guarantee absolute security
• You are responsible for protecting your account credentials

10. Disclaimers and Limitations

Platform Availability

• We strive to maintain Platform availability but cannot guarantee uninterrupted service
• Maintenance, updates, or technical issues may temporarily affect Platform access
• We are not liable for losses due to Platform unavailability

Third-Party Services

• Our Platform integrates with third-party payment processors and email services
• We are not responsible for the performance or policies of third-party services
• Your use of third-party services is subject to their respective terms

Disclaimer of Warranties

• THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE

11. Limitation of Liability

Liability Limits

• OUR LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM IS LIMITED TO THE AMOUNT YOU PAID FOR TICKETS IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITS MAY NOT APPLY TO YOU

Force Majeure

• We are not liable for delays or failures due to circumstances beyond our reasonable control
• This includes natural disasters, government actions, internet outages, or other force majeure events

12. Intellectual Property

Platform Rights

• We own all rights to the Platform design, software, and content (except user-generated content)
• You may not copy, modify, or distribute our Platform without permission
• Our trademarks and logos may not be used without written consent

User Content License

• You grant us a non-exclusive license to use content you submit for Platform operations
• This license includes the right to display, process, and transmit your content
• You retain ownership of your content and may delete it at any time

13. Termination

Account Termination

• You may terminate your account at any time through your account settings
• We may terminate accounts that violate these Terms or engage in prohibited activities
• Upon termination, your right to use the Platform ceases immediately

Effect of Termination

• Valid raffle tickets remain valid for scheduled drawings even after account termination
• We may retain certain information as required by law or legitimate business purposes
• Subscription cancellations take effect at the end of the current billing period

14. Dispute Resolution

Governing Law

• These Terms are governed by Wisconsin state law
• Any disputes will be resolved in Wisconsin courts
• Wisconsin law applies regardless of conflict of law principles

Dispute Process

• We encourage resolving disputes through direct communication first
• If informal resolution fails, disputes may be subject to binding arbitration
• Class action lawsuits are waived in favor of individual arbitration

16. Compliance and Legal Requirements

Wisconsin Raffle Law Compliance

• All raffles must comply with Wisconsin Statutes Chapter 563
• Participating organizations must maintain valid Wisconsin raffle licenses
• We reserve the right to suspend raffles that do not meet compliance requirements

Reporting Requirements

• We maintain records as required by Wisconsin law
• Information may be provided to regulatory authorities upon request
• Winners of prizes $600 or more will be reported as required by law

18. Miscellaneous

Entire Agreement

• These Terms, together with our Privacy Policy, constitute the entire agreement between you and us

• Invalid provisions will be modified to be enforceable while preserving their intent

No Waiver
